GENERAL CONDITIONS OF SALE IN ARTS
Preamble
The iN ARTS company offers artistic workshops in different fields (drawing, writing, gastronomy, photography, singing, etc.), combining artistic practice and cultural walks, these workshops being able to take place outdoors and in museums, within ” a workshop or in “online” versions, under the name “Virtual artistic getaway”, as well as artistic team-building type events for companies or individuals. iN ARTS is a company incorporated under French law, with a share capital of 8,000 € whose head office is located at 11, avenue Jean Aicard 75011 Paris in France, registered under number RCS 894 291 426.

Client : refers to the person who purchases an iN ARTS service, the Client may or may not be the Beneficiary of the Service depending on whether he will make personal use of the service or if he is will offer.
Beneficiary : refers to the person participating in the Service.
Service : refers to the artistic workshop or Team-Building event in which the Beneficiary participates.
Site : designates the place of the Service
3. Prices
The prices appearing on the site www.inarts-travel.com or mentioned in the commercial documents provided by iN ARTS are expressed in euros and inclusive of tax. They are likely to be revised at any time depending on the revision of pricing policy. The current price is that applied on the iN ARTS website on the day of the firm and final order.

5. Handicap
It is necessary to specify when booking the practical necessities according to the handicap. For workshops that take place in part in a museum or artist’s studio, a special request will then be made to the Site to find out the accessibility conditions. In the event that access is not possible due to a lack of infrastructure linked to the Site, iN ARTS cannot be held liable.
6. Method of payment and terms of payment
6.1 For the different Services, several payment methods are possible: Check / Secure online payment / Bank transfer.
6.2 Payment method for Team-Building services, the payment is staggered as follows: a deposit of 50% of the total amount of the event will be requested upon signing the contract and the balance on the day of event. In the event of cancellation of the order for Team Building Services, iN ARTS reserves the right to claim financial compensation of 30% of the entire invoice, depending on the preparation costs already incurred.
7. Cancellation & refund conditions
For artistic workshops that take place partly outside, these Services are maintained regardless of the weather conditions. They can nevertheless be the subject of an adaptation of the program initially planned in order to ensure the comfort of all. The Beneficiary must adapt his outfit to the weather conditions expected on the day of his workshop. iN ARTS reserves the right to cancel one of its Services in the event of force majeure, unforeseeable unavailability of the trainer and the impossibility of replacing him, or in the event of an insufficient number of participants. In the event of cancellation at the initiative of iN ARTS, the participants concerned will be notified by e-mail (via the e-mail address provided by the customer when booking), with a proposal to postpone to other slots and in the event that no time slot would suit the Beneficiary, iN ARTS will issue a full refund. In the event of cancellation by the customer, the reimbursement conditions are as follows: for a cancellation more than 5 days before the reserved Service, a credit note will be issued to be used against a future Service. For a cancellation less than 5 days before the booked Service, no refund or credit will be issued.
8. Timetable
It is imperative to respect the schedules of the Service, as well as the meeting place, indicated on the confirmation. In the event of a delay, the Customer may be refused integration into the workshop concerned. Any delay or no show is considered a withdrawal and does not give rise to any refund.
9. Security
The trainer supervising the workshops can decide for the safety of the group to ask one or more Beneficiaries not to take part, or to leave the group during the workshop. The Beneficiary concerned must then opt-in. A Beneficiary thus excluded by the trainer will not be able to claim any reimbursement. The Beneficiary must be respectful towards the trainer and the other participants in the artistic workshop. The trainer will give the safety instructions to be followed throughout the workshop. The Beneficiary undertakes to respect them scrupulously. For outdoor workshops, it is forbidden to move away from the group, except in cases of necessity related to safety, or when requested by the trainer to deal with an exceptional case. The Beneficiary will be fully responsible if he finds himself in a situation of infringement within the sight of French law.
10. Insurance and Guarantee
IN ARTS has taken out an insurance policy covering its professional civil liability with xxxx. The customer is responsible for all damages resulting from his doing.
The Beneficiary accepts that any accident which would occur during the workshop and which could injure him is in no case the responsibility of iN ARTS and he also takes full responsibility for any accident that he may cause to others during his participation in an artistic workshop IN ARTS.
The Beneficiary declares that he is indeed the holder of an insurance policy of civil liability.
11. Major forces
Is a case of force majeure or a fortuitous event any external, unforeseeable and irresistible event within the meaning of article 1148 of the Civil Code, independent of the will of iN ARTS and hindering the realization of the services sold, in particular the acts of public power, hostilities, wars, riots, acts of the prince, natural disasters, fires, floods, exceptional bad weather, hindering the proper functioning of iN ARTS as well as damage, failures or delays one or more providers, the blocking of telecommunications, the blocking of the Internet, the breakdown of the equipment broadcasting the service, the interruption of transport, the supply of energy, raw materials … The party wishing to invoke a force majeure event must immediately notify the other party of the beginning and end of this event, otherwise it cannot be released from its responsibility.
12. Personal data
Concerned about respecting the privacy of the Client and protecting the information transmitted by the Client to iN ARTS, iN ARTS complies with the legislation in force in terms of the protection of privacy. iN ARTS will have to collect personal data concerning the Customer, in particular when ordering Services.
Certain information requested from the Customer, when placing the order, is required to validate the order concerned. iN ARTS may send the Client information allowing him to better understand the offers offered, such as monthly newsletter. However, the Customer will have the possibility to object to the use of his contact details when these are collected. In accordance with the provisions of the law of 25 May 2018 relating to data protection, the Customer is informed that he has the right to access, rectify and delete personal data concerning him. 13. Image rights
Any recording or photograph made by IN ARTS during participation in the artistic workshop may be used for promotional purposes. Upon simple written request, the Customer has the option of requesting by email to the address contact@inarts-travel.com to remove a publication in which it appears. Under no circumstances will the customer be able to claim any financial compensation.
14. Withdrawal period
The right of withdrawal does not exist for contracts relating to the provision of accommodation, transport, catering and leisure services, which are provided on a date or according to a determined periodicity. As such, the services of artistic workshops iN ARTS are not subject to this deadline.
15. Applicable law - disputes
Any complaint relating to a Service must be submitted to iN ARTS within 72 working hours of the end of the Service only by registered mail. In the event of a persistent disagreement, disputes may be submitted to iN ARTS, which will endeavor to find an amicable agreement. Any dispute relating to the application of these conditions will fall under the exclusive jurisdiction of the courts of the city of Paris.
